TERMS AND CONDITIONS OF HIRE
PARTIES:
This Hire Agreement (βAgreementβ) is made and entered into on the date of booking between:
1. Archive. By Cene Studio (βOwnerβ) and
2. The Hirer (βHirerβ), whose details are outlined in the booking form.
1. DEFINITIONS:
1.1 βItemsβ refer to the rental products listed in the invoice.
1.2 βHire Periodβ refers to the agreed period for which the Items are hired.
1.3 βHire Feeβ refers to the total amount payable by the Hirer for the use of the Items.
1.4 βSecurity Depositβ refers to any refundable amount held for damages or losses.
1.5 βBondβ refers to the refundable amount charged based on item type and quantity, held as security against loss or damage.
2. HIRE TERMS:
2.1 The Owner agrees to hire the Items to the Hirer for the Hire Period specified in the booking.
2.2 The Hirer agrees to use the Items solely for their intended purpose and at the agreed location.
2.3 The Hirer is responsible for ensuring the Items are kept in good condition and are returned on time.
3. PAYMENT:
3.1 A 50% non-refundable deposit is required at the time of booking.
3.2 The remaining balance is due 14 business days prior to the event date.
3.3 A Bond will be required and will be refunded within 7 business days after the Items are returned in satisfactory condition.
3.4 If Items are lost or damaged, their replacement value will be deducted from the Bond, and the remaining amount will be refunded.
3.5 Should the cost of loss or damage exceed the Bond amount, the Hirer will be invoiced separately
for the full amount of damages.
4. DELIVERY, COLLECTION & SETUP:
4.1 The Owner will arrange delivery and collection at an additional cost unless agreed otherwise.
4.2 The Hirer must ensure that access to the venue or receiver location is suitable for delivery.
4.3 Any additional labor required for setup or styling will incur additional charges.
5. CUSTOMER PICKUP & RETURN:
5.1 Pick-up and return times will be specified in the booking confirmation and must be strictly adhered to.
5.2 A missed pick-up will result in the forfeiture of the full Hire Fee.
5.3 Failure to return the Items at the specified time will result in a secondary hire fee, which will be deducted from the Bond. This is calculated as per our 4-day hire policy.
6. CARE & DAMAGE:
6.1 The Hirer is responsible for the Items from the time of delivery until collection.
6.2 Any damage, loss, or theft of the Items will be charged to the Hirer at the full replacement cost.
6.3 The Hirer must not alter, modify, or attempt to repair any Items.
6.4 The Hirer must follow all provided instructions for the proper use and care of the Items.
6.5 Failure to follow instructions that results in damage to the Items may result in the cost of repair or replacement being deducted from the Bond.
7. CANCELLATION & REFUNDS:
7.1 Cancellations must be made in writing.
7.2 If cancellation occurs within 7 days of the Hire Period, the full Hire Fee is payable.
7.3 Refunds for early returns will not be issued.
8. LIABILITY & INDEMNITY:
8.1 The Owner is not liable for any injury, damage, or loss caused by the Items during the Hire Period.
8.2 The Hirer agrees to indemnify the Owner against any claims arising from the use of the Items.
9. FORCE MAJEURE:
9.1 The Owner shall not be liable for failure to fulfill its obligations due to circumstances beyond its control, such as natural disasters, strikes, or government restrictions.
10. GOVERNING LAW:
10.1 This Agreement is governed by the laws of Australia.
10.2 Any disputes shall be resolved through mediation or legal proceedings in the appropriate jurisdiction.
11. AGREEMENT & ACCEPTANCE:
By making a booking and paying the deposit, the Hirer acknowledges and agrees to the terms of this Agreement.
